1. Use of the Subscription Service by Future Code and our Customers

The Future Code Newsletter Service

Our online Service allows any company that uses it (our customers and Future Code itself) to create and share marketing, sales and customer service content. The Newsletter Service can also be used to help organize sales data about a company?s sales pipeline (e.g., leads, customers, deals, etc.). The information added to the Newsletter Service, either by site visitors providing their contact information or when a Newsletter or Subscription Service user adds the information, is stored and managed on our service provider servers. This information is then used to contact visitors about their interest in the company's goods or services and interact with the company. Future Code provides the Newsletter Service to our customers for their own marketing, lead generation, and customer service needs, and we use it to meet Future Code's related needs.

Use by Future Code

We use our own Newsletter Service to build webpages that people can visit to learn more about Future Code. Information that we collect and manage using the Newsletter or Subscription Service for our own marketing belongs to us and is used, disclosed and protected according to this Privacy Policy.

Use by Our Customers

Our customers use the Newsletter or Subscription Service to build webpages that people can visit to learn more about their business. Future Code does not control the content of these webpages or the types of information that our customers may choose to collect or manage using the Subscription Service. That information belongs to them and is used, disclosed and protected by them according to their privacy policies and is not subject to this Privacy Policy. Future Code processes our customers information as they direct and in accordance with our agreements with our customers, and we store it on our service provider servers, but we do not have control over its collection or management. Our agreements with our customers prohibit us from using that information, except as necessary to provide and improve the Subscription Service, as permitted by this Privacy Policy, and as required by law. We have no direct relationship with individuals who provide Personal Information to our customers. Future Code acknowledges that you have the right to access your Personal Information. Our customers control and are responsible for correcting, deleting or updating information they have collected from you using the Subscription Service. If requested to remove data we will respond within a reasonable time period. We may work with our customers to help them provide notice to their visitors about their data collection, processing and usage. Our agreements with our customers prohibit them from using the Subscription Service to collect, manage, or process Sensitive Information. We are not responsible for our customers use of information they collect on the Subscription Service.

Future Code collects information under the direction of its customers, and has no direct relationship with the individuals whose Personal Information it processes. If you are a customer of one of our customers and would no longer like to be contacted by one of our customer that use our Newsletter or Subscription Service, please contact the customer that you interact with directly. We may transfer Personal Information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our customers.

Sensitive Information

This refers to credit or debit card numbers, personal financial account information, Social Security numbers, passport numbers, driver's license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health condition or information, or other employment, financial or health information.

2. Information We Collect

When You Visit our Websites

You are free to explore the Websites without providing any Personal Information about yourself. When you visit the Websites or register for the Newsletter or Subscription Service, we request that you provide Personal Information about yourself, and we collect Navigational Information.

Log Files

When you use our services our view content provided by us, we automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. This information is used by Future Code for the operation of the Subscription Service, to maintain quality of the Newsletter or Subscription Service, and to provide general statistics regarding use of the Future Code Website. For these purposes, we do link this automatically-collected data to Personal Information such as name, email address, address, and phone number.

Information we collect from third parties

From time to time, we may receive Personal Information about you from third party sources including partners with which we offer co-branded services or engage in joint marketing activities, and publicly available sources such as social media websites.

This service provider is not permitted to store, retain, or use the information you provide except for the sole purpose of credit card processing on our behalf.

Our Websites include Social Media Features, such as the Facebook Like button and Widgets, such as the Share This button or interactive mini-programs that run on our sites. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Websites. This Privacy Policy does not apply to these features. We offer publicly accessible message boards, blogs, and community forums. Please keep in mind that if you directly disclose any information through our public message boards, blogs, or forums, this information may be collected and used by others. We will correct or delete any information you have posted on the Websites if you so request, as described in "Opting Out and Unsubscribing" below.

Retention of Personal Information

How long we keep the information we collect about you depends on the type of information. as described in further detail below. After such time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible.

We retain Personal Information that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required in order to contact you about the Subscription Service or our other services, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements).

When we have no ongoing legitimate business need to process your Personal Information, we securely delete the information or anonymize it or, if this is not possible, then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. We will delete this information from the servers at an earlier date if you so request, as described in "To Unsubscribe from Our Communcations" below.

If you provide information to our customers as part of their use of the Subscription Service, our customers decide how long to retain the personal information they collect from you. If a customer terminates its use of the Subscription Service, then we will provide the customer with access to all information stored for the customer by the Subscription Service, including any Personal Information provided by you, for export by the customer according to our agreement with our customer. After termination, we may, unless legally prohibited, delete all customer information, including your Personal Information, from the Subscription Service.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.

4. How We Share Information We Collect

Service Providers

We employ other companies and people to provide services to visitors to our Websites, our customers, and users of the Subscription Service and may need to share your information with them to provide information, products or services to you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis, providing marketing assistance, processing credit card payments, supplementing the information you provide us in order to provide you with better service, and providing customer service or support. Future Code Partners

In addition, we may share data with trusted partners to contact you based on your request to receive such communications, help us perform statistical analysis, or provide customer support. Such third parties are prohibited from using your Personal Information except for these purposes, and they are required to maintain the confidentiality of your information.

We partner with trusted third parties to provide you with co-marketing content that we think may be relevant to you. When you engage with these co-marketing partners, we will tell you who we are sharing data with, and provide a link to the co-marketing partner?s privacy policy so you can learn more about how to opt-out of the partner?s communications. Corporate Events

If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by Future Code on the Websites and the Subscription Service. 5. Cookies and Similar Technologies


Future Code and its partners use cookies or similar technologies (such as web beacons) to analyze trends, administer the website, track users? movements around the website, and to gather demographic information about our user base as a whole. Navigational Information Collected by Our Customers

Our customers can use the tools we provide, as well as tools provided by third parties, to collect Navigational Information when you visit their web pages on the Subscription Service. Future Code does not control our customers use these tools, nor do we control the information they collect or how they use it.

Flash Cookies and Other Third Party Tracking Technologies

The Adobe Flash Player (and similar applications) use technology to remember settings, preferences and usage similar to browser cookies but these are managed through a different interface than the one provided by your Web browser. This technology creates locally stored objects that are often referred to as "Flash cookies." Future Code does not use Flash cookies. However, the customers of our software platform may create pages on the Future Code platform that employ Adobe Flash cookies.


We partner with a third party ad network to either display advertising on our Web site or to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons to collect information about your activities on this and other Web sites to provide you targeted advertising based upon your interests. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out. Please note this does not opt you out of being served to advertise. You will continue to receive generic ads.

6.1 Information We Collect from Users (?User Information?)

We automatically collect User Information when Users interact with our Services that appear on our Customers' websites and digital properties. Like most other web-based services, we collect this User Information through cookies and other technologies. Future Code collects only pseudonymized data, which means we do not know who you are because we do not know or process your name, email address, or other identifiable data. User Information that we collect includes, but is not limited to, Information about a User?s device and operating system, IP address, the web pages accessed by Users within our Customers? websites, the link that led a User to a Customer's website, the dates and times a User accesses a Customers' website, event information (e.g., system crashes), general location information (e.g., city and state), hashed email addresses (when made available by the User), and gender (when made available by the User). We ask our Customers to obtain consent on our behalf, where required by applicable data protection laws, for us to collect this User Information. We may also obtain Information about you from our data partners.

6.2 How We Use User Information

Providing our Service. We may use User Information to provide our Services to Users and our Customers.

Tailoring content. We may use User Information to tailor the content and information that we may send or display to Users; to retarget content to Users through our Services and elsewhere; and to otherwise personalize your experiences while using our Services. For more information about how we tailor our content see information below about our Interest Based Advertising section.

Tailoring content across multiple devices. We may use User Information to improve a unique User?s experience across multiple browsers and devices (such as smartphones, tablets, or other viewing devices) by providing better targeted ad campaigns to that User. For instance, should we recognize a User on a web browser, we may want to provide that User similar or personalized content on mobile apps, as well. Offering our Customers data segments that help target content and advertisements for topics, products, and services that may interest you. A data segment is a grouping of users who share one or more attributes (e.g., travel enthusiasts). We offer a number of data segments, both proprietary and from our data partners, to our Customers so that they may better target Users who are more likely to be interested in their content and advertisements. Future Code does not knowingly create segments that are based upon what we consider to be sensitive information (for example, Personal Data revealing your racial or ethnic origin or your religious affiliations, or Personal Data concerning your sensitive health information, sex life or sexual orientation, or genetic or biometric data).

6.3 How We Disclose User Information

We may disclose User Information as follows:

Future Code Affiliates. We may disclose User Information to any current or future Affiliates, parent companies, or subsidiaries to process for the purposes described in this Privacy Policy.

Future Code service providers. We may disclose User Information to vendors, service providers, agents, contractors, or others who perform functions (e.g., maintenance, data analysis, customer relationship management, email marketing, surveys, credit card processing, data hosting, or fraud detection) on our behalf.

Unaffiliated third parties. Through our Services, including our Services on Customer websites, we may provide advertisements to you based on your recent browsing behavior across different Customer websites, browsers, or devices. For example, if on a first online visit, you browse on website A, then on a subsequent visit to website B, you may see content personalized based on your browsing history on website A. For example, if a user visits a clothing retail site, she might see clothing-related ads on another site she visits.

In order to target advertisements to you for products and services that may interest you, we may use cookies, JavaScript, web beacons (including clear GIFs), HTML5 local storage, and other technologies.

We may also work with third parties such as ad networks, which are third parties that display advertisements based on your visits to websites that you have visited in the past. These advertisers will deliver you targeted advertisements for products and services that may interest you. 6.6 User Choices and Opting Out

Future Code supports initiatives to offer our Users greater transparency and control over the uses of their Information. Therefore, we offer the following options for controlling the interest-based content and ads you receive.

If you do not want to receive interest-based ads from Future Code, you can disable the display of such ads. Please note that an opt out will not prevent you from seeing Future Code?s content recommendations. Rather, the opt out will prevent Future Code from using your Information to tailor these recommendations to your interests. You will continue to receive recommendations that are selected based on the particular website that you are viewing (i.e., contextually based ads).

6.7 Data Retention

We retain User Information, which is directly collected for purposes of serving ads, for at most thirteen (13) months from the User?s last interaction with our Services (often for a shorter period of time), after which time we de-identify the data by removing unique identifiers or aggregating the data.

We retain de-identified or aggregated data, which cannot identify an individual or device and is used for purposes of reporting and analysis, for as long as commercially necessary. We keep opt-out information for longer than this period so that we can continue to honor your opt-out requests.
